OLD Approach: UAE Labour Law
In Dubai, the most common types of employment contracts are limited and unlimited contracts. Limited contracts are those that have a specific period, whereas unlimited contracts do not have a specified period and are open-ended.
Employment contracts can be terminated by the employer as well as the employee for different reasons, regardless of the nature of the contract. However, various laws govern the termination of employment contracts. Federal Law No. 8 of 1980 of the UAE regulates employment in the UAE and is known as labour law. According to article 113 of the labour law, an employment contract can be terminated in the following ways:
Mutual agreement between both parties, where the employee’s consent is given in writing.
Expiry of the term of the contract, unless specified otherwise.
For the convenience of either the employee or the employer, provided that the conditions related to the notice period and valid grounds of termination are properly met.
The labour law defines the reasons for the termination of a limited contract in-depth and also provides the various reasons under which the contract can be terminated by the employer and the employee separately. Furthermore, labour law also defines the reasons under which an unlimited contract can be terminated. An unlimited contract can only be terminated for a valid reason that is strictly work-related, meeting the requirements related to the notice period.
